  1. I. ESTABLISHMENT:                                                                                                    Up 

1. The African Center for Research and Studies on Terrorism (referred to here as "the Center") has been established in accordance with the provisions contained in Section H, paragraphs 19 to 21, of the African Union Plan of Action on the Prevention and Combating of Terrorism in Africa, as well as the relevant decisions of the political organs of the Union, in particular the following: Assembly/AU/Dec.15 (II); EX.CL/Dec.13 (II); EX / CL/Dec.82 (IV) and EX/CL/Dec.126 (V).

2. The Center has been established as a structure of the Commission, under the Protocol to the OAU Convention on the prevention and fight against terrorism, which entrusts the African Union' Peace and Security Council with the responsibility for implementing the regional, continental and international tools for combating terrorism, and for harmonizing and coordinating efforts.

  1. HEADQUARTERS:                                                                                               Up 

The headquarters of the Center will be in Algiers, Algeria. Once the center is operational, the African Union will sign a Headquarters Agreement with the host country in accordance with the practice, the principles of the African Union and the international rules on the matter.

 

  1. STATUS AND SITUATION :                                                                                      Up 

1.       1. The Center shall

(i)         Be a structure of the African Union Commission. Its objective is to strengthen the Union's capacity to address issues relating to the prevention and the fight against terrorism. It will function as a center of excellence for research in the areas of prevention and fight against terrorism in Africa ;

(ii)        Serve the interests of the African Union by providing the necessary technical expertise in the field of combating and preventing terrorism in Africa ;

(iii)       Be guided by the objectives and principles enshrined in the Constitutive Act of the African Union, the Protocol Relating to the Establishment of the Peace and Security Council of the African Union, the OAU Convention on the Prevention and Combating of Terrorism and the Protocol thereto, and in the Plan of Action adopted in September 2002, as well as other relevant instruments and decisions of the Union, the United Nations Charter and any other legal instruments that African countries have signed;

(iv)        Work in cooperation with the national focal points designated by the Member States ;

(v)         Develops its own program of studies and activities and its budget for each fiscal year, in consultation with national focal points.

 

  1. Objectives OF THE CENTER :                                                                             Up 

The Center's goal is to help strengthen the capacities of the African Union in the areas of prevention and fight against terrorism in Africa, and the final objective is the elimination of the threat it poses to peace, security and to the development of Africa. In this regard, the Center will centralize information, studies and analysis on terrorism and terrorist groups, establish training programs and organize, with the support of international partners, training programs, meetings and symposia.

  1. FUNCTIONS:                                                                                                          Up 

1.   Pursuant to the objective included in Section IV above, the functions devolved to the Center are, among others, the following  :

(i)         To assist Member States of the African Union to develop strategies for prevention and combating terrorism;

(ii)         To develop methodologies for the collection, processing and dissemination of information;

(iii)        To provide technical and professional advice as to the implementation of the African Union instruments relating to the fight against terrorism, including the Convention of 1999 and the Protocol thereto, and the Plan of Action for the Prevention and the fight against terrorism; updating and strengthening the AU's policies and programs for combating terrorism;

(iv)        To create and maintain a database covering various matters relating to the prevention and the fight against terrorism, particularly on terrorist groups and their activities in Africa, as well as on the experts and the technical assistance available. The database and analyses will be accessible to all the Member States of the Union;

(v)         To promote coordination and harmonization of efforts to strengthen the capacity of the Member States in the prevention and fight against terrorism;

(vi)        To undertake and disseminate periodically the results of research and policy analyses in order to sensitize Member States on current trends. The Center will publish regularly the conclusions of its research and analysis in the form of an African Review on the prevention and the fight against terrorism;

(vii)       To develop programs of cooperation and assistance with similar and / or concerned institutions at the national, regional, continental level, in terms of research, information collection and analysis of issues related to the prevention and the fight against terrorism;

(viii)      To undertake studies converging on other global security issues related to terrorism that represent a threat to peace and security in Africa;

(ix)        To develop early warning capabilities to facilitate rapid response, integrating the concept of preventive management of crises;

(x)        To provide technical and professional advice on the best way for Africa to contribute, with more impact, to the international campaign against terrorism, including the implementation of relevant international instruments by the Member States of the African Union;

(xi)        To Conduct studies and make recommendations as to the strengthening and standardization of legal standards and cooperation in matters of information sharing among Member States, of assistance, of extradition, of police and border control (land, sea and air) in Africa;

(xii)       To undertake research and analysis so as to determine the best strategies and methods to put an end to the financing of terrorism;

(xiii)      To organize workshops, seminars, symposia and training programs for capacity building of the Member States and regional mechanisms in the field of prevention and fight against terrorism in Africa;

(xiv)      To submit to the President of the Commission, annual activity reports for consideration by the legislative organs of the African Union. Such reports include the activities of the previous year and the budget for the planned activities of the next fiscal year.

2.   The Center may also have to perform tasks that could be requested by the African Union Commission or the Peace and security Council in the area of prevention and fight against terrorism in Africa.

 

  1. CODE OF CONDUCT:                                                                                         Up 

1.   Given the sensitive nature of the issues addressed by the Center, and in order to safeguard its credibility, the Center shall:

(i) Maintain a degree of confidentiality and stringent security measures in the

 collection and dissemination of information and data relating to terrorism.

 

(ii) Ensure that the information it publishes or disseminates is reliable and

verifiable.

 

(iii) Comply with the academic codes of conduct and ethics governing research and analysis.

 

(iv) Regularly organize seminars for Member states, to raise their awareness,

to address major problems and challenges and to foster efforts aiming at

preventing and combating terrorism in Africa.
 

  1. COMPOSITION AND STRUCTURE:                                                                    Up 

1. The Center will be headed by a Director. The latter will report to the President of the Commission through the Commissioner for Peace and Security. The Commission will develop an organizational chart and a detailed structure for the Center. The organizational chart and structure will be presented to the relevant decision-making bodies of the African Union for consideration and approval.

2. The Center will have a library and technical and electronic equipment (software and hardware).

3. The Center will be staffed locally and internationally. The staffing of the center will be governed by the Rules of Procedure of the African Union.

4. The Director will be assisted by an Advisory Council, established by the President of the Commission. The Council will be composed of a representative from each of the five regions and a representative from each REC, from the focal points of the Center and selected through consultation with Member States, and RECs. Representatives of the Commission shall also sit within the Council. This Council will serve as a mechanism of the Commission for periodic review and / or evaluation of studies and activities programs, budget and finance and other operational and administrative aspects for the effective performance of the Center in accordance with the Rules of Procedure of the Union. It will, inter alia, have the following functions:
 

(i) Review and assess the programs and activities of the Center to ensure they are oriented and achievable within a specific period, consistent with the mandate and functions of the Center as contained in the working conditions, updated according to the prevailing trend on terrorism and that meeting the needs of the Union Member States, and meet the needs of the African Union Member States;

(ii) Review the structure and budget of the Center in the light of its activities and needs in order to make recommendations to the decision-making bodies of the Union;

(iii) Make recommendations to the President of the Commission on the ways to bring the Center to maximum performance.
 

 

  1. FINANCING:                                                                                                       Up 

1.   Without prejudice to the autonomy and Statute of the Center as a structure of the Commission,

(i)         The Center will be funded from the regular budget and the extra budgetary funding sources to be mobilized by the Commission;

(ii)         The Center prepares its annual budget and submits it to the African Union Commission for consideration and approval by the relevant decision-making bodies of the Union.

 

  1. WORKING CONDITIONS:                                                                                     Up 

Conditions of work and terms of service, including the remuneration of the staff of the Center, shall be based on the Rules of Procedure of the African Union.
